Welcome to the Canfish Affiliate Program ("Program")! By participating in the Program, you ("Affiliate" or "you") agree to be bound by the following terms and conditions ("Agreement"). Please read them carefully before applying or promoting Canfish products. Canfish ("we," "us," or "Merchant") reserves the right to update or modify these terms at any time, with notice provided via email or our Affiliate Program dashboard.
1.Definitions
"Affiliate": An individual or entity approved to promote Canfish products in exchange for commissions.
"Merchant": Canfish, the owner of www.canfish.com and provider of fishing gear, apparel, and accessories.
"Program": The Canfish Affiliate Program, managed through our affiliate platform.
"Tracking Link": A unique URL or code provided to Affiliates to track clicks, sales, or leads.
"Transaction Value": The net sale amount of a completed purchase, excluding taxes, shipping, and additional fees, unless otherwise specified.
2.Enrollment
2.1. To join the Program, you must submit a complete application via our affiliate platform at www.canfish.com/affiliates. We reserve the right to approve or reject applications at our sole discretion.
2.2. You must be at least 18 years old, provide accurate legal and contact information, and maintain an active website, blog, or social media presence aligned with our brand values.
2.3. Approved Affiliates will receive access to a dashboard for Tracking Links, promotional materials, and performance reports.
3.Commission Structure
3.1. Affiliates earn a commission of 8% on the Transaction Value of each valid sale referred through their Tracking Link, subject to the terms below.
3.2. Transaction Value excludes:
Value-Added Tax (VAT), sales tax, or any other applicable taxes.
Shipping or delivery charges.
Credit card processing fees or other payment-related fees.
3.3. Commissions are paid only on completed transactions (i.e., orders that are paid, shipped, and not returned or canceled within the return period of 30 days).
3.4. Commissions are calculated based on the last-click attribution model, meaning only the Affiliate whose Tracking Link was last clicked before a sale receives credit.
4.Payment Terms
4.1. Commissions are paid monthly, on or around the 15th of the following month, provided the Affiliate’s earned commissions exceed $50. Payments below this threshold will roll over to the next cycle.
4.2. Payments are made via PayPal or bank transfer to the account specified in your Affiliate profile. You are responsible for ensuring accurate payment details.
4.3. Canfish is not responsible for taxes, duties, or fees associated with commission payments. Affiliates must comply with applicable tax laws.
5.Promotional Guidelines
5.1. Affiliates may use approved banners, text links, and product images provided through the Affiliate dashboard. Unauthorized use of Canfish’s trademarks, logos, or intellectual property is prohibited.
5.2. Prohibited promotional methods include, but are not limited to:
Bidding on Canfish trademarks or misspellings in paid search campaigns (e.g., Google Ads).
Using Tracking Links in spam emails, pop-ups, or cookie-stuffing.
Promoting Canfish products on websites or platforms containing illegal, offensive, or adult content.
5.3. Affiliates must disclose their affiliate relationship with Canfish in accordance with FTC guidelines (e.g., including “#ad” or “affiliate link” in promotions).
5.4. Affiliates may not offer unauthorized coupons, discounts, or incentives unless provided by Canfish.
6.Tracking and Reporting
6.1. Sales and commissions are tracked via the Tracking Link and our affiliate platform. Canfish’s tracking data is the sole basis for determining commissions.
6.2. Affiliates can access real-time performance reports, including clicks, sales, and commissions, through the Affiliate dashboard.
6.3. Transactions resulting from fraud, chargebacks, or violations of this Agreement will not earn commissions.
7.Intellectual Property
7.1. Canfish retains all rights to its trademarks, logos, product images, and other intellectual property. Affiliates are granted a limited, non-exclusive license to use approved materials solely for Program purposes.
7.2. Affiliates may not modify Canfish’s logos, banners, or content without prior written consent.
7.3. Upon termination of this Agreement, Affiliates must immediately remove all Canfish-related materials from their platforms.
8.Termination
8.1. Either party may terminate this Agreement at any time with written notice (email to affiliates@canfish.com is sufficient).
8.2. Canfish may terminate or suspend an Affiliate’s account immediately for:
Violation of this Agreement or Canfish’s brand guidelines.
Fraudulent activity, including cookie-stuffing or fake referrals.
Inactivity for 6 months or failure to maintain an active promotional platform.
8.3. Upon termination, unpaid commissions may be forfeited if termination is due to a violation of this Agreement.
9.Liability and Indemnification
9.1. Canfish’s liability is limited to the commissions earned by the Affiliate in the 12 months preceding any claim.
9.2. Affiliates agree to indemnify Canfish against claims arising from their promotional activities, including misrepresentations or unauthorized use of Canfish’s intellectual property.
9.3. Canfish provides the Program “as is” without warranties, express or implied.
10.Modifications
10.1. Canfish may modify this Agreement at any time. Affiliates will be notified via email or the Affiliate dashboard. Continued participation after the notice period (14 days) constitutes acceptance of the updated terms.
10.2. If you do not agree to the modified terms, you may terminate this Agreement by emailing affiliates@canfish.com.
11.Governing Law
11.1. This Agreement is governed by the laws of the State of [Insert State, e.g., Delaware], United States, without regard to conflict of law principles.
11.2. Disputes will be resolved through arbitration in [Insert City, e.g., Wilmington, Delaware], unless otherwise agreed.
