Affiliate Marketing Terms and Conditions
1. Introduction
This agreement outlines the terms and conditions for participation in the Guestz marketing program (the "Program"). By participating, you (the "Affiliate") agree to abide by these terms.
2. Enrollment in the Program
- To participate, Affiliates must submit an application to join the Program.
- Guestz reserves the right to accept or reject any affiliate application at its sole discretion.
- Once approved, the Affiliate will receive a unique referral link to use in their promotional activities.
3. Affiliate Obligations
- Affiliates must promote Guestz's products/services in a lawful and ethical manner.
- Affiliates cannot engage in any form of fraudulent or misleading marketing techniques (e.g., false advertising, click fraud).
- Affiliates are prohibited from bidding on Guestz’s trademarked keywords in paid advertising or using the trademark in domain names, social media handles, or paid search ads without explicit written consent.
4. Commission Structure
- Affiliates will earn a commission based on [specific model: percentage of sales, lead generation, clicks, etc.].
- Commission rates may vary based on the type of product or service being promoted. Guestz will communicate these details clearly.
- Payment will be made [monthly/quarterly] via [PayPal, bank transfer, etc.], provided the minimum payout threshold is met.
5. Payment Terms
- Payments are processed on a [net 30] basis (i.e., 30 days after the end of the calendar month).
- Affiliates are responsible for paying any taxes due on commissions earned.
- If an Affiliate’s commission is subject to chargebacks or refunds, the relevant amount will be deducted from future payments.
6. Intellectual Property
- Affiliates are granted a non-exclusive, non-transferable license to use Guestz trademarks, logos, and promotional materials solely for the purpose of promoting the products/services.
- All intellectual property remains the sole property of Guestz.
7. Affiliate Links and Tracking
- Affiliates must only use the provided tracking links to ensure proper attribution and commission tracking.
- Any unauthorized use of tracking links or attempts to manipulate the system will result in termination from the Program.
8. Termination of the Agreement
- Guestz may terminate this agreement at any time, with or without cause, by providing notice to the Affiliate.
- The Affiliate may terminate their participation by notifying Guestz in writing.
- Upon termination, the Affiliate must cease using all Guestz logos, links, and intellectual property immediately.
9. Privacy and Data Protection
- Affiliates agree to comply with applicable privacy laws and regulations, including but not limited to the GDPR (General Data Protection Regulation), when collecting, using, and sharing personal data of customers.
- Affiliates are prohibited from collecting, storing, or using customer data without express consent from Guestz.
10. Disclaimer and Limitation of Liability
- Guestz makes no guarantees about the success of the Program or the amount of earnings an Affiliate may generate.
- Guestz is not responsible for any damages, losses, or claims resulting from the Affiliate's participation in the Program or the use of the products/services.
11. Governing Law
- These terms are governed by the laws of England and Wales and any disputes will be resolved in the appropriate courts of England and Wales.
12. Amendments
- Guestz reserves the right to modify these terms and conditions at any time. Affiliates will be notified of any material changes to the agreement.
13. Miscellaneous
- These terms represent the entire agreement between Guestz and the Affiliate.
- Any waiver of any provision of these terms will not be deemed a waiver of any other provision.
