PROGRAM CONDITIONS
CONDITIONS FOR PARTICIPATION IN THE WEMPE AFFILIATE PROGRAM
In addition to the AWIN Terms and Conditions of Participation, the following terms and conditions apply to the participation and advertising in the affiliate program of Gerhard D. Wempe GmbH & Co KG, hereinafter referred to as Wempe.
The Wempe affiliate program is operated in cooperation with Awin. A partnership is established by applying for the Wempe affiliate program and activating the candidate as a partner.
Upon activation for the affiliate program, the partner agrees to comply with the following conditions of participation.
ADVERTISING:
The advertising of Wempe and its products may only take place in an appropriate environment. Advertising and the use of advertising materials is not permitted in the following environments:
- Websites with pornography, depictions of violence, insults, extremist, radical political or youth-endangering content
- Websites that contain dialers and/or spyware or install them on the Internet user's computer; websites that contain discriminatory, insulting or defamatory statements regarding race, gender, religion, nationality, disability, sexual orientation or age
- Content that violates common decency and applicable laws or the rights of third parties
- Doorway pages, "under construction" websites without their own content
- Paid mail systems or paid home pages
- Banner networks
- Typo domains
- Unlawful use in the listed or other inappropriate environments can lead to immediate exclusion from the Wempe affiliate program.
ADVERTISING MATERIAL
Only the advertising material made available on Awin by Wempe may be used. Use is permitted exclusively for the affiliate program and related placements. The use of self-created and/or modified advertising material is not permitted. An exception to this is advertising material that has been made available to Wempe in advance for review and approval and has been demonstrably approved by a contact person at Wempe.
PRODUCT DATA
Wempe provides product data for the purpose of advertising. This data may only be used on the partner’s own websites and within the scope of this partnership.
BAN ON ADVERTISING FOR BRANDS:
Only the brands listed in Section 5 “Commission” are allowed to be advertised. Other brands are currently subject to an advertising ban. Wempe reserves the right to include additional brands at a later date.
COMMISSIONS:
Wempe grants the commissions listed in the program conditions exclusively on the brands:
- Wempe By Kim
- Wempe Fine Jewelry
- Wempe High Jewelry
- Wempe 137
- Wempe Glashütte i.SA
Special collaborations of the four listed brands.
Other brands are currently excluded from commission.
The commission is paid on the net merchandise value, minus any vouchers and/ or discounts.
VOUCHERS
Only vouchers provided by Wempe as part of the affiliate program may be used for advertising. Vouchers that are not communicated via the affiliate program may not be used for advertising purposes. Wempe reserves the right to exclude unauthorized vouchers and orders associated with them from commission.
CANCELLATION
Wempe reserves the right to terminate partnerships with an exceptionally high cancellation rate.
VIOLATIONS OF THE CONDITIONS
Wempe reserves the right to terminate partnerships in the event of breaches of these terms and conditions and to cancel any outstanding commissions.
CHANGES TO THE CONDITIONS
Wempe reserves the right to change, shorten, or extend the program conditions.
LIABILITY
We are liable for intent and gross negligence. Furthermore, we are liable for the negligent breach of obligations whose fulfillment makes the proper execution of the contract possible in the first place, whose violation endangers the achievement of the contract’s purpose, and on whose compliance you, as the customer, can regularly rely. In the latter case, however, we are only liable for foreseeable, contract-typical damages. We are not liable for the slight negligent breach of obligations other than those mentioned in the preceding sentences. The above exclusions of liability do not apply in cases of injury to life, body, or health. Liability under the Product Liability Act remains unaffected.
(2) Data communication over the internet cannot currently be guaranteed to be error-free and/or available at all times according to the current state of technology. We are therefore not liable for the constant and uninterrupted availability of our online trading system.
