1. Trademark Regulations
Approach Tours and the associated logo are the exclusive property of Approach Tours. Affiliates are granted a limited, non-exclusive, non-transferable license to use the Approach Tours trademarks solely for the purpose of promoting Approach Tours through the ShareASales affiliate program. Affiliates must comply with the following policies:
- The trademark must be used in its entirety without any alterations.
- Affiliates may not use the trademark in any manner that implies endorsement or sponsorship beyond the affiliate relationship.
- The trademark may not be used in any derogatory, defamatory, or misleading manner.
- Affiliates must not use the trademark in a domain name, social media handle, or online identifier without prior written permission.
2. Email Marketing Policy
Affiliates promoting Approach Tours through email marketing must adhere to all applicable local laws and the CASL (Canadian Anti-Spam Legislation) laws. This includes:
- Obtaining explicit consent from recipients before sending promotional emails.
- Providing a clear and easy method for recipients to unsubscribe.
- Ensuring truthful and non-misleading email content.
3. Grounds for Termination
Approach Tours reserves the right to terminate the affiliate agreement immediately if an affiliate:
- Violates trademark regulations.
- Engages in fraudulent or unethical marketing practices.
- Misrepresents Approach Tours or its services.
- Uses unauthorized coupons, discounts, or incentivized traffic.
- Fails to adhere to social media and advertising policies.
4. PPC Advertising Policy
Affiliates must comply with the following PPC advertising rules:
- Do not bid on restricted keywords including "Approach Tours," variations, or brand terms.
- Do not use Approach Tours in display URLs, ad titles, or ad copy without approval.
- Direct linking to the Approach Tours website from PPC ads is prohibited.
- Negative keywords must include "Approach Tours" to prevent bidding conflicts.
- No competitor targeting to redirect traffic to Approach Tours.
- Violations may result in immediate termination and forfeiture of commissions.
5. Prohibited Content & Advertising Restrictions
Affiliates may NOT promote Approach Tours on websites or marketing channels that contain:
- Adult content, pornography, or escort services.
- Gambling, sports betting, or casino-related content.
- Illegal drugs, tobacco, e-cigarettes, or vaping products.
- Weapons, firearms, or content that promotes violence.
- Hate speech, discriminatory content, or misleading claims.
- Pirated or illegal content, hacking, or counterfeiting.
- Clickbait, fake endorsements, or deceptive advertising.
6. Coupon and Deal Policy
Approach Tours does not allow the use of coupons, discounts, or incentivized traffic. Affiliates may not:
- Offer unauthorized coupons or special offers.
- Use cashback, points, or incentive-based marketing.
7. Payment Terms
Affiliates earn commission once a user completes their purchase by making a deposit payment. If a user issues a chargeback for the deposit, no commission will be paid, and any paid fees will be reclaimed.
8. Sales Tax
Approach Tours collects and pays sales tax for all purchases in Quebec. Affiliates are not responsible for handling tax.
9. Waiver of Liability
Approach Tours is not liable for indirect, incidental, or consequential damages arising from this agreement. Liability is limited to commissions earned in the six months preceding a claim.
10. Severability
If any provision of this agreement is found to be unenforceable, the remaining terms will remain in full effect.
11. Survivability
Provisions related to trademark use, payment terms, liability, and legal compliance will survive termination of this agreement.
12. Governing Law
This agreement is governed by the laws of the Province of Quebec, Canada.
13. Entire Agreement
This agreement constitutes the full understanding between parties, superseding all prior agreements.
Agreement Acceptance
By participating in the Approach Tours affiliate program, you agree to comply with these terms. Approach Tours reserves the right to modify this agreement at any time.
