2025 Affiliate Terms of AgreementThis Affiliate “TOA” Terms of Agreement (“Agreement”) describes the rights and obligations of affiliates in the LanierPens (known as LanierPens.com) affiliate program.LanierPens.com reserves the right to reject any web site or affiliate if we determine, in our sole discretion and following our review of your site or marketing efforts, that your site or marketing efforts are unsuitable and unacceptable for any reason. This includes but is not limited to, inclusion of content that is in any way illegal, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically, or otherwise objectionable, or that includes or promotes sexually explicit materials, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age. Payments and ReportsAs an affiliate with LanierPens.com affiliate program through the ShareaSale network, you will have access to your free affiliate account information via username and password. All affiliate media and payments will be handled through Shareasale.Commissions will not be paid if LanierPens.com affiliate program has determined one of the following problems with a sale.a)The sale was conceived with the use of a stolen credit card or fraudulent card informationb)The product was returned within 10 days of purchasec)The sale was cancelled within 48 hours of purchased) Customer initiates charge back independentlyAll affiliate commissions will be payable to you through your affiliate ShareaSale account. All statistics, reports and program information can also be accessed through your ShareaSale account. As an affiliate with LanierPens.com affiliate program you must adhere to all ShareaSale terms of agreements. LanierPens.com Affiliate Commission Structure10% Commission on a sale minus shipping and coupon discounts. Once you reach a threshold, your commission may be increased. ( with approval from LanierPens.com)If you are interested in second tier commissions, please contact us.Cookies: The LanierPens.com affiliate program cookie will be set within ShareaSale for a 180 days period; LanierPens.com affiliate program is not responsible for any tracking issues known or caused through either a natural or unknown technical issue suffered by and from ShareaSale or through the affiliates website or the affiliates misplacement or misuse of tracking codes. Affiliate Advertisements and Links:All appropriate affiliate media including your affiliate tracking identification number will be generated through ShareaSale. Collateral for your website, email(s) or through your other marketing efforts can only be guaranteed to track properly if you retrieved it properly from ShareaSale. LanierPens.com Affiliate ObligationsYou are solely responsible for development, promotion, operation, and maintenance of your affiliate web site(s) and marketing efforts and ensuring your affiliate media is placed properly on your site. LanierPens.com Affiliate Termination Guidelines LanierPens.com affiliate program affiliate partners will be terminated immediately if one or more of the following is found. LanierPens.com also reserves the right to dissolve and expire any affiliate in our program for any reason deemed appropriate by the affiliate management team.1) If the affiliate creates a site that copies, resembles the look and feel of, or creates the impression that the Affiliate Site is the LanierPens.com web site.2) Operate or utilize a Web site or email link to Web sites that contain or promote any of these types of content: libelous, defamatory, obscene, pornographic, abusive, violent, bigoted, hate-oriented, illegal, cracking, hacking or warez, or that offer any illegal goods or services3)Engage in cyber-squatting or typo-squatting of the LanierPens.com domain or any trademark or other brand terms associated with LanierPens.com4) Purchasing or bidding for placement of keywords that are not allowable search terms as designated by LanierPens.com affiliate program or any variation or misspelling thereof of the brand name Lanier Pens or LanierPens.com trademarks all brand and trademark terms are off limits in all search engines.5) LanierPens.com, Lanier Pens and variations of our domain names, or misspellings without written consent from LanierPens.com6) Making any representations regarding the relationship with Lanier Pens or LanierPens.com, or using any trademark of LanierPens.com without written consent outside of the materials supplied for you through the ShareaSale network.7) Taking any action that could reasonably cause any customer confusion as to LanierPens.com relationship with your site or company. Such as making a false claim of employment or any other false claims concerning your relationship with LanierPens.com outside of the affiliate programs agreements. 8) Not adhering to current SPAM-ACT compliancy laws in emails.9) Defaming or slandering LanierPens.com by name or any employees name or representatives as such, image, products or any other defamatory statement either electronically, in print, web or media, or on blogs or forums.10) Employing any technology to read, intercept, record, redirect, interpret, or fill in the contents of any electronic form or other materials that we serve to customers who click through Links to the LanierPens.com web site.11) Altering the content of any Advertisement that LanierPens.com affiliate program provides, or creating inappropriate advertisements with Links to the LanierPens.com web site not authorized by LanierPens.com.12) Issuing any press release, announcement, or promotional material that uses the LanierPens.com name or trademarks without LanierPens.com’s direct approval upon issuance of an exact copy of media to be used.13) Making any warranty or representation concerning LanierPens.com products or services except those expressly stated by LanierPens.com affiliate program in Advertisements and on the LanierPens.com web site. TerminationEither you or we may end this Agreement AT ANY TIME, with or without cause, by giving the other party written notice. Written notice can be in the form of mail, email or fax. In addition, this Agreement will terminate immediately upon any breach of this Agreement by you. ModificationWe may modify any of the terms and conditions in this Agreement at any time at our sole discretion. In such event, you will be notified by email. Modifications may include, but are not limited to, changes in the payment procedures and LanierPens.com Affiliate Program rules. If any modification is unacceptable to you, your only option is to end this Agreement. Your continued participation in LanierPens.com’s Affiliate Program following the posting of the change notice or new Agreement on our site will indicate your agreement to the changes. PPC CampaignsAffiliates that use keywords or exclusively bid in their Pay-Per-Click campaigns on keywords such as Lanier Pens, Lanier Pen, Lanier-Pens, www.LanierPens.com, and/or any misspellings or similar alterations of these – be it separately or in combination with other keywords will be banned .You may bid on keywords that do not include our trademarked business name or url. – The traffic from such campaigns must be first directed to the affiliates website prior to re-directing it to ours. If this is not adhered to, it will be considered trademark violations, and affiliates will be banned from LanierPens.com’s Affiliate Program. We will do everything possible to contact the affiliate prior to the ban. However, we reserve the right to expel any trademark violator from our affiliate program without prior notice, and on the first occurrence of such PPC bidding behavior.
