Terms and Conditions

TERMS & CONDITIONS:

1. Introduction

These Terms and Conditions ("Agreement") govern your participation in the Pure Nails Affiliate Programme ("Programme"). By applying for and participating in the Programme, you ("Affiliate" or "You") agree to abide by these Terms and Conditions. This Agreement is between you and Pure Nails ("Advertiser" or "We").

2. Eligibility

  • You must be at least 18 years old and have the legal capacity to enter into agreements.
  • To participate, you must complete the affiliate registration process via the AWIN platform.
  • We reserve the right to approve or reject any affiliate application at our sole discretion.

3. Enrolment in the Programme

  • To join the Pure Nails Affiliate Programme, you must apply through our affiliate platform (via AWIN).
  • After submitting your application, we will review your details and notify you of acceptance into the Programme.
  • Pure Nails reserves the right to approve or reject any application based on our internal criteria.

4. Affiliate Obligations

  • Marketing and Promotion: As an Affiliate, you agree to promote Pure Nails products and services using the tools and marketing materials provided by us. 
  • Compliance: You agree to comply with all applicable laws and regulations, including those governing advertising, consumer protection, and privacy.
  • Ethical Practices: You agree to promote Pure Nails products/services in an ethical manner. Misleading or fraudulent practices, including but not limited to false claims or spamming, are prohibited.
  • Content Restrictions: You may not promote Pure Nails products via content that is offensive, discriminatory, or violates any intellectual property laws.

5. Prohibited Use of Unauthorised Discount Codes

  • Affiliates are strictly prohibited from distributing or using unauthorised discount codes for Pure Nails products or services. This includes any promotional or discount codes that are not officially provided by Pure Nails or included in our approved marketing materials.
  • The use of unauthorised discount codes to generate sales, whether through your website, or any other method, is considered a breach of these Terms and Conditions and will result in the immediate suspension or termination of your affiliate account.
  • Affiliates may only promote the discount codes provided directly by Pure Nails. These codes must not be used in a misleading or fraudulent manner or distributed without proper authorisation.
  • Pure Nails reserves the right to withhold commissions for sales made using unauthorised or fraudulent discount codes, and any such sales may be cancelled or reversed.

6. Affiliate Links and Tracking

  • The affiliate network, AWIN, will track sales and actions through your account.
  • It is your responsibility to ensure your tracking links are properly placed on your website, blog, or other promotional materials.

7. Commissions and Payments

  • Affiliates earn a commission for each sale, lead, or action that is generated through their referral links, as specified in the programme's commission structure.
  • Commissions will be paid via the AWIN platform.
  • Pure Nails or AWIN reserves the right to adjust commission rates, and you will be notified of such changes in advance.

8. Prohibited Activities

  • Affiliates must not engage in the following prohibited activities:
    • Misleading Advertising: Affiliates cannot use false or deceptive marketing methods or claims.
    • Spam: Sending unsolicited emails or engaging in spammy tactics is strictly prohibited.
    • Cookie Stuffing: The practice of hiding cookies to improperly track a sale or lead is prohibited.
    • Trademark Violations: Affiliates may not bid on Pure Nails' trademarks, brand names, or misspellings of them for paid advertising or in a misleading context.
    • Deceptive Tactics: Affiliates cannot make false promises or represent themselves as Pure Nails employees.
    • PPC (Pay-Per-Click) Advertising: Affiliates are prohibited from using Pure Nails' brand name, trademarks, or any variations of them in paid advertising (PPC), including but not limited to Google Ads, Bing Ads, or any other paid search platform. This includes bidding on Pure Nails' keywords or misspellings of Pure Nails' trademarks for paid search campaigns.

9. Intellectual Property

  • Pure Nails grants you a limited, non-exclusive, and revocable licence to use the Pure Nails trademarks, logos, and branding solely to promote products within the Programme.
  • You may not alter, modify, or misuse any of our intellectual property. Upon termination of your participation in the Programme, you must immediately cease using any of our trademarks and branding.

10. Termination

  • Either party (you or Pure Nails) can terminate this Agreement at any time with or without cause by providing written notice.
  • Upon termination, any outstanding commissions earned will be paid in accordance with the payout schedule.
  • We reserve the right to immediately terminate your account for any breach of these Terms and Conditions or if we believe you are engaging in unethical practices.

11. Limitation of Liability

  • Pure Nails will not be liable for any indirect, incidental, or consequential damages that may arise out of your participation in the Programme.
  • Our liability will be limited to the total commissions you have earned during the six months immediately prior to the event that gave rise to the claim.

12. Privacy and Data Protection

  • Affiliates must comply with all applicable privacy and data protection laws, including GDPR (if applicable), when handling customer information.
  • You agree to handle customer data securely and not to misuse or share any personally identifiable information (PII) without explicit consent.

13. Amendments

  • Pure Nails reserves the right to modify these Terms and Conditions at any time. Affiliates will be notified of any material changes, and your continued participation in the Programme constitutes your acceptance of the updated terms.

Acknowledgement: By joining the Pure Nails Affiliate Programme, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
