LeMieux Advertiser Programme – Terms & Conditions
These Terms & Conditions (“Terms”) govern participation in the LeMieux Advertiser Programme (“Programme”) operated via the AWIN affiliate network. By applying to and/or participating in the Programme, you (“Affiliate”, “you”, “your”) agree to comply with these Terms, in addition to the AWIN Publisher Terms & Conditions, which form part of this agreement.
1. Programme Overview
The LeMieux Advertiser Programme allows approved affiliates to earn commission by promoting LeMieux products through AWIN-tracked affiliate links, banners, and other authorised creative assets.
2. Commission
- Standard commission rate: 5% of the net sale value (excluding VAT, shipping, returns, and discounts).
- Commission is calculated on confirmed, valid sales tracked by AWIN.
- All commission payments are made via AWIN in accordance with their payment schedules.
3. Approval & Participation
- Participation is subject to approval by LeMieux and may be withdrawn at our sole discretion.
- Affiliates must ensure their promotional content accurately represents the LeMieux brand, products, and values.
- Websites, channels, or marketing methods that contain or promote offensive, illegal, misleading, or infringing content are strictly prohibited.
4. Promotional Materials & Brand Usage
- Affiliates may use only the creatives, product feeds, and assets provided in AWIN or expressly approved by LeMieux.
- Modification of logos, product imagery, or creative materials is not permitted without prior written approval.
- Affiliates must not misrepresent themselves as LeMieux or imply direct partnership beyond the scope of this Programme.
5. Prohibited Practices
Affiliates must not:
- Bid on “LeMieux” or related trademarked terms (including misspellings) in paid search campaigns.
- Use cookie stuffing, forced clicks, or any fraudulent tracking methods.
- Operate or promote through coupon, voucher, or cashback sites unless expressly authorised by LeMieux in writing.
- Send unsolicited email marketing campaigns (“spam”) featuring LeMieux without prior approval.
- Promote counterfeit or unauthorised resale of LeMieux products.
6. Tracking & Attribution
- All sales must be tracked via AWIN tracking links to be eligible for commission.
- LeMieux is not responsible for tracking failures due to user browser settings, ad blockers, or unapproved link modifications.
- Where multiple affiliates refer the same transaction, AWIN’s attribution rules will apply.
7. Returns, Cancellations & Invalid Transactions
- Commission will not be paid on returned, cancelled, or fraudulent orders.
- Any commission already paid on such transactions may be deducted from future payments.
8. Termination
- Either party may terminate participation in the Programme at any time via AWIN.
- Breach of these Terms or AWIN’s Publisher Terms may result in immediate termination and forfeiture of unpaid commission.
9. Changes to the Programme
- LeMieux reserves the right to amend commission rates, approved promotional methods, or any other Programme terms at any time.
- Changes will be communicated via AWIN or email with reasonable notice where possible.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
