Welcome to the Rosaholics Affiliate Program! These Terms and Conditions (T&Cs) govern your participation in the affiliate program ("Program") operated by Rosaholics.com ("Rosaholics," "we," "us," or "our") through the Awin platform ("Platform"). By participating in the Program, you agree to abide by these T&Cs
1. Eligibility
1.1 Participation in the Program is open to individuals aged 18 or older and businesses with valid tax identification numbers, subject to approval by Rosaholics.
1.2 Rosaholics reserves the right to reject any application at its sole discretion.
1.3 Participants must not:
- Promote illegal or unethical content.
- Compete directly with Rosaholics or have conflicts of interest.
2. Affiliate Obligations
2.1 Affiliates agree to:
- Use only the marketing assets provided or approved by Rosaholics.
- Ensure promotional activities comply with all applicable laws, including FTC guidelines for endorsements and disclosures.
2.2 Affiliates must not:
- Use spam, cookie stuffing, or misleading practices.
- Misrepresent their relationship with Rosaholics.
- Alter or misuse Rosaholics’ intellectual property.
- Offer discounts beyond what Rosaholics provides.
2.3 Affiliates are responsible for the content of their promotional materials and must align them with Rosaholics’ brand identity and values.
3. Affiliate Links and Tracking
3.1 Affiliates will receive unique tracking links through the Awin Platform.
3.2 Rosaholics uses cookies to track referrals. The cookie duration is 30 days.
3.3 Sales must be completed within the cookie duration for commissions to be eligible
4. Commission Structure
4.1 Commission rates are, by default, 20% of the net sale value, excluding taxes, shipping, and refunds.
4.2 Payments:
- Payment frequency: Monthly
- Payment methods: [e.g., Bank Transfer, PayPal]
4.3 Non-commissionable transactions include:
- Cancelled or refunded orders.
- Self-purchases by affiliates.
- Transactions outside the cookie duration.
4.4 Commission Eligibility:
Commissions apply to all sales when the buyer completes the purchase through the affiliate’s unique link. However, repeat purchases made by returning customers who originally visited the Rosaholics website without using the affiliate’s link will not generate a commission
5. Intellectual Property
5.1 Rosaholics grants affiliates a non-exclusive, revocable license to use its trademarks, logos, and marketing materials solely for the purpose of promoting Rosaholics.
5.2 Affiliates may not:
- Alter or modify any branding assets.
- Suggest unauthorized partnerships or endorsements
6. Termination
6.1 Either party may terminate this agreement at any time, with or without cause, by providing written notice.
6.2 Upon termination, affiliates must cease using all Rosaholics materials and tracking links.
6.3 Pending commissions for valid transactions prior to termination will be paid according to the standard schedule.
7. Program Modifications
7.1 Rosaholics reserves the right to modify the Program’s terms, commission rates, or rules. Changes will be communicated in advance.
7.2 Continued participation after changes constitutes acceptance of the updated terms.
8. Liability and Indemnification
8.1 Rosaholics is not liable for any indirect, incidental, or consequential damages arising from participation in the Program.
8.2 Affiliates agree to indemnify Rosaholics against claims, damages, or liabilities resulting from their actions or breaches of these T&Cs.
9. Confidentiality
9.1 Affiliates must not disclose confidential information about Rosaholics, including commission rates, internal processes, or marketing strategies.
11. Miscellaneous
11.1 Affiliates are independent contractors, not employees or agents of Rosaholics.
11.2 These T&Cs constitute the entire agreement and supersede all prior agreements related to the Program.
