General Terms and Conditions
Note: Any references to Article 11.7 of the Telecommunicatiewet, the ACM guidelines, and the Dutch Awin Code of Conduct are replaced by applicable UK legislation (including the Privacy and Electronic Communications (EC Directive) Regulations 2003 – PECR), relevant ICO guidelines, and the Awin UK Code of Conduct. Please ensure you comply with all relevant UK laws and the Awin Code of Conduct.
Sending Commercial Messages
Sending commercial messages through Awin is only permitted if the publisher can prove compliance with PECR, the ICO guidelines, and the Awin Code of Conduct.
The Awin Code of Conduct must be signed by the publisher and kept on record by Awin UK to be presented to the relevant authorities if requested.
Previews and Approval
All email campaigns must be submitted via the “Email Approval Tool” (found under “Toolbox” → “Email Campaign Approvals”) for approval before sending.
By submitting a preview, the publisher confirms compliance with UK law (PECR) and certifies that prior consent has been obtained from all email recipients.
The commercial message may only be sent after the advertiser has approved both the preview and the dispatch.
The publisher is responsible for any consequences arising from sending spam or commercial messages without the advertiser’s consent.
Consequences of Non-Compliance
If any mailing is sent without approval from Awin and Vivara, all resulting sales will be rejected.
Mailing Parties
Only email addresses obtained through a valid opt-in process, in line with UK regulations, may be used.
All promotional materials (including dispatch date, the number of addresses, sender, and subject line) must be submitted to the advertiser/account manager for approval. Every resend requires new approval.
Failure to do so may result in the advertiser rejecting any resulting sales and withholding payment.
