Below are the general terms and conditions of the GoMatcha affiliate program on the AWIN UK platform. By joining and promoting the GoMatcha affiliate program, you agree to abide by these terms. Please review them carefully before participating, as they outline your rights and obligations under our program.
**Enrollment and Approval**
* All affiliates must complete the AWIN UK application process for our program.
* We reserve the right to accept or reject any application, or to remove an affiliate from the program at any time if we determine they are not adhering to these terms or to AWIN UK’s policies.
**Commission Structure**
* Commission rates and payment schedules are established within AWIN UK and may be updated at our discretion.
* You will earn commission only on valid, tracked purchases that meet all of our program criteria (e.g., order verification, completed payment, and successful delivery).
* Commissions may be subject to review or reversal in cases of fraud, chargebacks, returns, or canceled orders.
**Marketing and Promotion**
* Affiliates may promote GoMatcha using only approved marketing materials, links, and assets provided in the AWIN UK interface.
* Affiliates must not engage in any misleading or fraudulent promotion, including but not limited to false advertising, unauthorized brand bidding on search engines, spam, or cookie stuffing.
* Any display of the GoMatcha brand or marketing collateral must adhere to our brand guidelines and AWIN UK’s compliance policies.
**Prohibited Activities**
* Affiliates may not promote GoMatcha on websites containing offensive, defamatory, or illegal content, or content that violates any intellectual property rights.
* Direct brand bidding (bidding on GoMatcha brand keywords or misspellings) is strictly prohibited unless expressly authorized in writing.
* Any activity that could harm GoMatcha’s reputation or violate applicable laws and regulations is not permitted and may result in immediate termination from the program.
**Data and Privacy**
* All affiliates must comply with data protection regulations (e.g., GDPR) and treat customer information with the highest level of confidentiality.
* Affiliates may not collect or use any personal data of visitors and customers beyond what is allowed within AWIN UK’s policies and in compliance with relevant data privacy laws.
**Intellectual Property**
* All trademarks, logos, and materials shared through the affiliate program remain the property of GoMatcha.
* Affiliates are granted a non-exclusive, revocable right to use these materials solely for the purpose of promoting GoMatcha within the agreed terms.
* Any unauthorized or non-compliant use of GoMatcha’s intellectual property may lead to termination of the affiliate relationship and possible legal action.
**Termination**
* Either party may terminate this agreement at any time, with or without cause.
* Upon termination, all rights and licenses granted to affiliates under these terms shall immediately cease.
* Affiliates must remove all references to GoMatcha marketing materials from their channels upon termination.
**Liability and Indemnification**
* GoMatcha is not liable for any indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising out of or in connection with this agreement.
* Affiliates agree to indemnify and hold harmless GoMatcha, its officers, directors, and employees from any legal claims, liabilities, damages, or expenses arising out of the affiliate’s participation in the program.
**Modification**
* We reserve the right to modify these terms at any time. Any changes will be communicated to affiliates via AWIN UK announcements or email.
* Continued participation in the GoMatcha affiliate program after any modifications constitutes acceptance of the updated terms.
**Governing Law**
* These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
**By participating in the GoMatcha affiliate program through AWIN UK, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.**
