Maamgic ShareASale Affiliate Program AgreementThis Program Agreement ("Agreement") is a legal document that sets forth the terms and conditions governing your participation in the Maamgic Affiliate Program ("Program") through the ShareASale platform ("Platform"). By applying for and participating in the Program, you agree to comply with the following terms:1. Affiliate Program Participation1.1 Eligibility: To participate in the Program, you must submit an application through the ShareASale platform. Maamgic reserves the right to accept or reject any application at its sole discretion without providing a reason.1.2 Account Responsibility: You are responsible for maintaining accurate account details, including your payment information, on the ShareASale platform. Failure to do so may delay or forfeit your commission payments.2. Prohibited ActivitiesAs an affiliate, you agree to refrain from engaging in the following activities:2.1 Unauthorized Use of Intellectual Property: Affiliates are strictly prohibited from using Maamgic's trademarks, logos, or copyrighted materials without prior written consent.2.2 Deceptive or Misleading Advertising: Affiliates must not use false, misleading, or deceptive practices in promoting Maamgic’s products, including making unsubstantiated claims or misrepresentations.2.3 Spamming: Affiliates may not engage in email spam, comment spam, or any other unsolicited promotional tactics.2.4 Paid Search Restrictions: Affiliates are prohibited from bidding on Maamgic-branded keywords, including but not limited to "Maamgic," "Maamgic Swimwear," or variations/misspellings thereof, on search engines (e.g., Google, Bing, etc.).2.5 Domain Restrictions: Affiliates may not purchase or register domain names containing Maamgic trademarks or misspellings thereof.2.6 Cookie Stuffing: Affiliates are strictly prohibited from using cookie stuffing techniques or other methods designed to generate fraudulent affiliate commissions.2.7 Unapproved Discount Codes: Affiliates must only promote Maamgic-approved discount codes. Use of unapproved codes may result in forfeiture of commissions and/or removal from the Program.3. Commission Structure and Payment3.1 Commission Rates: Affiliates will earn commissions based on the rates published on the ShareASale platform. These rates are subject to change at Maamgic’s sole discretion.3.2 Payment Schedule: Commissions will be paid on a monthly basis through the ShareASale platform, provided the affiliate meets the minimum payout threshold as defined by ShareASale.3.3 Reversals: Commissions will not be paid on returned, refunded, or canceled orders. If a commission has already been paid on such an order, it will be deducted from future payments.4. Termination4.1 Termination by Maamgic: Maamgic reserves the right to terminate your participation in the Program at any time, with or without cause, and without prior notice.4.2 Termination by Affiliate: You may terminate your participation in the Program at any time by providing written notice to Maamgic.4.3 Effect of Termination: Upon termination, you must immediately cease using all Maamgic trademarks, logos, and promotional materials. Any outstanding commissions will be paid in accordance with Section 3.5. Limitation of LiabilityMaamgic shall not be held liable for any direct, indirect, incidental, or consequential damages arising from your participation in the Program, including but not limited to loss of revenue, data, or profits.6. Governing LawThis Agreement shall be governed by and construed in accordance with the laws of the [Insert Jurisdiction], without regard to its conflict of law principles.7. Modifications to the AgreementMaamgic reserves the right to modify this Agreement at any time. Affiliates will be notified of any changes via the ShareASale platform. Continued participation in the Program after such modifications constitutes your acceptance of the updated terms.By participating in the Maamgic Affiliate Program, you acknowledge that you have read, understood, and agreed to abide by this Agreement.
