Affiliate Obligations
- Accurate Information: You must provide accurate and truthful information in your application and update your information if it changes.
- Compliance with Laws: Affiliates must comply with all applicable laws, regulations, and guidelines, including local advertising laws and the Federal Trade Commission's guidelines on endorsements and testimonials.
- Financial Responsibility: You agree to be financially responsible for all taxes, fees, and other expenses incurred through your participation in the Affiliate Program.
- Self-Promotion: Affiliates are encouraged to promote TurnCage via ethical channels, including your website, blog, social media, email marketing, and other approved platforms.
- Reporting Violations: Affiliates should report any violations of these Terms or misuse of the Affiliate Program to TurnCage immediately.
Website Restrictions
Your participating website(s) or platform may NOT:
- Intellectual Property Infringement: Infringe on our or anyone else’s intellectual property, publicity, privacy, or other rights.
- Legal Compliance: Violate any law, rule, or regulation.
- Prohibited Content: Contain any content that is threatening, harassing, defamatory, obscene, hateful, violent, discriminatory, harmful to minors, or contains nudity, pornography, or sexually explicit materials.
- Malware: Contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines intended to damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.
- Unauthorized Software: Contain software or use technology that attempts to intercept, divert, or redirect internet traffic to or from any other website, or that potentially enables the diversion of affiliate commissions from another website, including toolbars, browser plug-ins, extensions, and add-ons.
- Domain Name Restrictions: Include the words "TurnCage" or any other TurnCage trademark in your domain name, including any variations, abbreviations, or misspellings.
- Illegal Content: Share links to any illegal audio/video download sites.
- Unapproved Distribution: Share links in eBooks, PDFs, or other digital formats without prior approval.
Commission on Sale
TurnCage and Affiliate agree to the commission based on the agreed-upon program terms in TurnCage’s affiliate network website, which you may find after logging in at ShareASale.com.
Linking to Our Website
Upon acceptance into the Program, links will be made available to you through the affiliate network interface on ShareASale.com. Your acceptance in our Program means you agree to and abide by the following:
- Authorized Linking: You will only use linking code obtained from the affiliate interface without manipulation. You may shorten the exact code provided in the affiliate interface through URL shortener services.
- Domain Disclosure: All domains that use your affiliate link must be listed in your affiliate profile.
- No Imitation: Your website will not in any way copy, resemble, or mirror the look and feel of our website. You will not use any means to create the impression that your website is our website, including, without limitation, framing our website in any manner.
- No Deceptive Practices: You may not engage in cookie stuffing or include pop-ups, false or misleading links on your website.
- Transparent Referrals: You will not attempt to mask the referring URL information (i.e., the page from where the click is originating). Using redirects to bounce a click off a domain from which the click did not originate to give the appearance that it came from that domain is prohibited.
- No Unauthorized Redirects: If you are found redirecting links to hide or manipulate their original source, your current and past commissions may be voided, or your commission level will be set to 0%. This does not include using "out" redirects from the same domain where the affiliate link is placed.
Online Advertising Guidelines
If you are enrolled in our Program and participate in online advertising, such as Google Ads or social media advertising, you must adhere to our Online Advertising Guidelines by not doing any of the following without TurnCage’s prior written consent:
- Trademark Bidding Prohibition: Bidding on the TurnCage brand in search engine or social media advertising, including but not limited to our domain name, company name, and trademarks or registered URLs, including any variations, abbreviations, or misspellings.
- Keyword Restrictions: You may not use our trademarked or brand terms in sequence with any other keyword (e.g., "TurnCage Coupons"), including any misspellings.
- Ad Content Restrictions: You may not use our trademarked terms in your ad title, ad copy, display name, ad extensions, or as the display URL, nor may you cloak or mask these URLs in online advertising campaigns.
- Direct Linking Prohibition: You may not direct link to our website from any online ad or use redirects that yield the same result (a.k.a. URL hijacking). Affiliates must direct users to an actual page on their website.
- Originality Requirement: You may not use the same tone, text, or images as our current or past ads. All paid ads need to have a different look and feel than TurnCage’s current or past ads, and you may not use the word “official” in connection with TurnCage's name in domain names, search ads, or on landing pages.
- Automated Advertising Responsibility: If you automate your online advertising campaigns, it is your responsibility to exclude our trademarked, brand, and misspelled terms from your program. We strongly suggest you add our trademarked, brand, and misspelled terms as negative keywords.
Note: We have a strict no-tolerance policy on online advertising trademark bidding. If you are unsure whether a term is trademarked, branded, or misspelled, it is your responsibility to reach out to us to find out. Violations may result in forfeiture of commissions and termination from the Program.
Email Advertising & Publicity
If you intend to promote our Program via email campaigns, you must:
- Authorized Communications: Send emails on your own behalf and not imply that the email is sent on behalf of TurnCage.
- Compliance with Laws: Comply with all applicable laws, including the CAN-SPAM Act and other applicable anti-spam laws.
- Content Approval: Send copies of all emails to jeannine@sleddogconsulting.com for approval before distribution.
- Accurate Representation: Do not make false or misleading claims about TurnCage's products, services, or policies.
- No Press Releases: You will not issue any press release or create any marketing material that states or implies that you are a “partner” with TurnCage or have any relationship other than as a member of our Affiliate Program without prior written consent.
Social Media Guidelines
Promotion on social media platforms is permitted following these guidelines:
- Personal Promotion: You are allowed to promote affiliate offers on your own social media accounts, such as Facebook, Instagram, YouTube, Twitch, Twitter, and Pinterest.
- No Spamming: You are prohibited from posting your affiliate links on TurnCage’s official social media pages in an attempt to generate affiliate sales.
- Advertising Restrictions: You are prohibited from running any social media ads (e.g., Facebook, X, TikTok, Instagram, or Pinterest) using TurnCage’s company name or trademarks without written approval.
- Account Imitation Prohibition: You are prohibited from creating social media accounts, pages, or posts that in any way copy, resemble, represent, or mirror the look and feel of our social media accounts, pages, or posts. You will not use any means to create the impression that your accounts, pages, or posts are TurnCage's official accounts.
Cookie Stuffing / Forced Clicks
You must not mislead customers into clicking on an offer or coupon that does not exist or practice deceptive tactics known as "cookie stuffing" or "forced clicks." These include, but are not limited to:
- Expired Offers: Using knowingly expired offers or presenting offers that do not exist or are not affiliate offers.
- Activation Deception: Making claims that a user must click on a link first to activate or receive an offer.
- Hidden Clicks: Presenting a button that claims to show all offers that sets the affiliate cookie in the background.
- Automated Clicks: Using technology that generates a click or sets the cookie from the action of copying a coupon code or through a pop-under.
Note: Violations may result in commission reversals, reduced commission rates, or suspension from the Program.
Coupon Guidelines
If you are enrolled in our Program and your website promotes coupon codes, you must adhere to our Coupon Guidelines:
- Authorized Coupons Only: You may only advertise coupon codes that are provided to you through the affiliate program or network.
- Full Disclosure: Coupons must be displayed in their entirety with the full offer, valid expiration date, and code.
- No Unauthorized Codes: You may not advertise coupon codes that you did not obtain through the Affiliate Program, including codes from marketing emails, paid search, or any non-affiliate advertising campaigns.
- No Misrepresentation: You may not give the appearance that any ongoing TurnCage promotional offer requires clicking from your website to redeem.
- No Circumvention: Posting any information about how to work around the requirements of a coupon or promotion (e.g., the requirement that a person be a first-time client) is prohibited and may result in removal from the Program.
Sub-Affiliate Networks
Promoting TurnCage through a sub-affiliate network is permitted; however, you must:
- Transparency: Be transparent regarding where traffic from your sub-affiliates originated.
- Compliance Enforcement: Ensure that all sub-affiliates promoting the TurnCage Program adhere to these Terms, including restrictions on advertising through toolbars, browser extensions, and paid placements.
- Coupon Sub-Affiliates: Receive approval prior to allowing any type of coupon sub-affiliate to promote the TurnCage Program.
Note: Failure to comply with our sub-affiliate network terms may result in a loss and/or reduction of commissions from sales made through any sub-affiliate that does not comply with our Program terms.
Domain Names
Use of any of TurnCage's trademarked terms, including any variations, abbreviations, or misspellings, as part of the domain or sub-domain for your website is strictly prohibited (e.g., "TurnCage.website.com").
FTC Endorsement Guidelines & Disclosure Requirements
If you are compensated by TurnCage in any way for a post—including with cash, credit, discounts, product, contest entries, and so on—you must clearly and conspicuously disclose such compensation. This applies across all media channels.
For example:
- On social media platforms like Instagram, TikTok, X, Facebook, YouTube, or Twitch, if you are promoting TurnCage or showing products given to you by TurnCage, you must include hashtags such as #ad, #sponsored, or #TurnCageAffiliate prominently in your caption, before any "more" link or truncation.
- The disclosure should be placed in a way that is hard to miss and in language that is easy to understand.
For more information about FTC guidelines, please review the FTC's Endorsement Guides.
Operations Outside the United States
If you conduct business in or take orders from persons in other countries, you must follow the laws of those countries. For example, you must comply with the European Union’s General Data Protection Regulation (GDPR) if you are conducting business in or taking orders from persons in one or more European Union countries.
Reversal & Communication Policy
TurnCage reserves the right to reverse orders (commissions) due to order cancellations, duplicate tracking, disputed charges, returns, and program violations as outlined in these Terms. Additionally, if we request clarification or more information on any orders or clicks that we suspect may be in violation of these Terms, we expect that you will respond in a timely and honest manner.
Orders may be reversed due to duplicate tracking, suspected fraud, or disputed charges. Affiliates should ensure transparency and accuracy in their reporting to avoid these issues.
Violations of our communications policy include:
- Lack of Transparency: You are not forthcoming, intentionally vague, or found to be lying.
- Unresponsiveness: You are not responsive within a reasonable time period and after multiple attempts to contact you using the information listed in your affiliate profile.
- Inability to Verify Traffic Sources: You cannot substantiate or validate the source of your traffic to our Program with clear and demonstrable proof.
If any of the above apply, then we reserve the absolute right to reverse orders, set your commission to 0%, or suspend you from the Program for the period or orders in question. It is incumbent upon each affiliate to ensure appropriate checks and balances are in place to proactively address these issues and adhere to our Program rules.
We know that many violations may result from automated processes; therefore, it is imperative for each affiliate to ensure that appropriate checks and balances are in place. Affiliates must proactively manage any automated systems to prevent unintentional breaches of these Terms.
Liability
TurnCage will not be liable for any indirect, incidental, special, or consequential damages (or any loss of revenue, profits, goodwill, or data) arising in connection with the Affiliate Program or these Terms, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to these Terms and the Program will not exceed the total commissions paid or payable to you under these Terms during the six (6) months immediately preceding the date on which the event giving rise to the most recent claim of liability occurred.
Amendments
TurnCage reserves the right to update or modify these Terms at any time. We will notify you of any material changes, and your continued participation in the Affiliate Program after such changes have been made constitutes your acceptance of the new Terms.
Termination
TurnCage may suspend or terminate your account or remove you from the Affiliate Program immediately and without prior notice if:
- You breach any of these Terms.
- You engage in any conduct that TurnCage deems, in its sole discretion, to be harmful to its business interests or the reputation or goodwill associated with TurnCage.
Upon termination, you will immediately cease use of and remove all links to the TurnCage website, and all TurnCage trademarks, trade dress, and logos, and all other materials provided by or on behalf of us to you pursuant hereto or in connection with the Program.
Agreement Acknowledgement
By participating in the TurnCage Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any of these Terms, please do not join or continue participating in the Program.
