1. Program Overview
ANDYOU offers an affiliate marketing program designed to promote our e-sports chairs and generate sales. Affiliates will earn commissions based on sales generated from promotional content.
2. Eligibility
To participate in the Program, you must:
Be a content creator, influencer, or affiliate marketer with an online presence relevant to e-sports, gaming, or related industries.
Sign up through the Awin platform or contact us via andyoueu@163.com.
Have a valid and active account with Awin, or agree to set one up for payment purposes.
3. Product Supply and Promotional Content
Product Provision: Once your participation in the Program is approved, we will send you one of our premium e-sports chairs as a gift, to be used for creating high-quality promotional content .
Content Requirements: The promotional content must be genuine, honest, and aligned with our brand values. It should highlight the features and benefits of the product clearly and authentically.
Approval Process: All promotional content must be approved by ANDYOU before publication. Any content that does not meet our standards or misrepresents the product may be rejected.
4. Commission Structure
Sales-Based Commissions: Affiliates will earn commissions based on sales directly generated through their promotional content. The exact commission rate will be determined and communicated by ANDYOU upon acceptance into the Program.
Additional Commissions: Affiliates may also earn additional commissions based on the volume of sales or specific promotional milestones achieved as a result of their content.
Payment: Commissions will be paid through the Awin platform, according to their payment terms and schedule.
5. Responsibilities of the Affiliate
Promotion of Products: Affiliates must promote ANDYOU products in a professional manner, adhering to the provided guidelines.
Content Integrity: Affiliates agree not to use misleading or false claims when promoting the products.
Compliance: Affiliates must comply with all applicable laws, advertising regulations, and Awin’s policies regarding online marketing, disclosures, and affiliate marketing.
6. Intellectual Property
Use of ANDYOU’s Assets: You are granted a limited, non-exclusive, and non-transferable license to use ANDYOU's brand logos, product images, and other marketing materials solely for the purpose of promoting the products in accordance with this Agreement.
Ownership: All intellectual property rights related to ANDYOU products and marketing materials remain the exclusive property of ANDYOU.
7. Termination
Either party may terminate this Agreement at any time, with or without cause, by providing written notice. Upon termination, you will no longer be entitled to commissions on new sales generated after the termination date. All commissions owed up to the date of termination will be paid as per the agreed payment terms.
8. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the Program, including but not limited to sales data, promotional strategies, and marketing plans.
9. Limitation of Liability
ANDYOU will not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, arising from your participation in the Program. The total liability for any claim will not exceed the amount of commissions earned by the Affiliate during the 3-month period prior to the event that caused the claim.
10. Changes to the Agreement
ANDYOU reserves the right to modify or amend these Terms and Conditions at any time. Affiliates will be notified of any significant changes. Continued participation in the Program constitutes acceptance of any revised terms.
11. Governing Law
This Agreement will be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.
