Terms and Conditions of the Ode Books Affiliate Program
Welcome to the Ode Books Affiliate Program. By joining our program and promoting our flagship product, Ode to the Wine Bottle, you agree to the following terms and conditions. Please read them carefully.
1. Eligibility
1.1. To participate, you must:
Be at least 18 years old.
Operate a website, blog, or social media channel that aligns with the values and mission of Ode Books.
Be approved by Ode Books after completing the application process through the Awin platform.
1.2. Ode Books reserves the right to reject any application at its discretion, including but not limited to websites containing inappropriate or unlawful content.
2. Affiliate Responsibilities
2.1. You agree to promote Ode to the Wine Bottle in a truthful, ethical, and professional manner.
2.2. You will not engage in any activities that harm the reputation of Ode Books, including but not limited to:
Spamming.
False advertising.
Misrepresentation of the product.
2.3. Affiliates are prohibited from bidding on paid search terms containing "Ode Books" or related trademarks.
2.4. Affiliates must disclose their relationship with Ode Books to comply with local advertising laws and regulations (e.g., including #ad or #affiliate in promotional content).
3. Commission Structure
3.1. Standard Commission: Affiliates earn 15% commission on all eligible sales generated through their unique affiliate links.
3.2. Performance Bonus: Affiliates earning over €1,000 in sales in a single month will receive 20% commission on sales exceeding this threshold.
3.3. Special Campaigns: During specific promotional periods, Ode Books may offer an increased commission rate, communicated to affiliates in advance.
3.4. Payment:
Commissions are calculated based on the net sale amount (excluding shipping, taxes, and returns).
Payments are processed through the Awin platform according to their payment schedule.
4. Tracking and Attribution
4.1. Sales are tracked using cookies set via the affiliate’s unique link.
4.2. Cookies have a 30-day duration. If a customer completes a purchase within this window, the affiliate will receive credit for the sale.
4.3. If multiple affiliates refer the same customer, the last-click attribution model applies.
5. Prohibited Activities
5.1. Affiliates are prohibited from:
Creating websites, domains, or social media accounts that impersonate Ode Books.
Using unauthorized or misleading promotional materials.
Offering unauthorized discounts or incentives.
5.2. Violation of these terms may result in immediate suspension or termination from the program.
6. Termination
6.1. Either party may terminate this agreement at any time, with or without cause, by providing written notice via email.
6.2. Upon termination, all rights to use Ode Books’ marketing materials and trademarks cease immediately.
6.3. Any pending commission payments for valid sales made before termination will be processed according to Awin’s schedule.
7. Liability
7.1. Ode Books is not responsible for any indirect, special, or consequential damages arising from the affiliate’s participation in the program.
7.2. Affiliates agree to indemnify and hold harmless Ode Books from any claims or liabilities arising from their promotional activities.
8. Modifications
8.1. Ode Books reserves the right to modify these terms at any time. Affiliates will be notified of changes via email or the Awin platform.
8.2. Continued participation in the program after modifications constitutes acceptance of the updated terms.
9. Governing Law
9.1. These terms and conditions are governed by the laws of Belgium, and any disputes shall be resolved in the courts of Antwerp.
