Affiliate Agreement for No Particular Order
This Affiliate Agreement ("Agreement") is made by and between No Particular Order ("Company") and the affiliate ("Affiliate") using the ShareASale platform. By joining our affiliate program, you agree to the following terms and conditions:
1. Trademark Regulations
The Affiliate agrees not to use No Particular Order’s trademarks, logos, or copyrighted content without prior written permission, except as provided through ShareASale’s affiliate tools.
Use of the Company's trademarks in domains, social media handles, or other online profiles is strictly prohibited unless authorized in writing.
2. FTC Disclosure Requirements
Affiliate agrees to comply with all Federal Trade Commission (FTC) guidelines, including providing clear and conspicuous disclosures when promoting No Particular Order products.
Disclosures must inform consumers of the affiliate relationship in a visible, prominent manner, such as through statements like "This is an affiliate link, and I may earn a commission."
3. Email Marketing Requirements
The Affiliate may not use unsolicited commercial email (spam) to promote No Particular Order products.
All email marketing must comply with the CAN-SPAM Act and include a clear unsubscribe option.
The Affiliate may not represent themselves as No Particular Order in any email communication and must use only approved templates or promotional materials provided by the Company.
4. Grounds for Termination
The Company reserves the right to terminate the Agreement at any time, with or without cause.
Grounds for termination include, but are not limited to:
Use of false or misleading advertising.
Violations of this Agreement.
Non-compliance with FTC, CAN-SPAM, or other legal requirements.
Engaging in behavior that could damage the Company’s reputation.
5. Social Media Policy
Affiliates may promote No Particular Order on social media but must clearly indicate the affiliate nature of the promotion.
Paid social media ads mentioning No Particular Order must follow the Company’s guidelines and be pre-approved.
Affiliates are prohibited from creating or operating any social media accounts solely for the purpose of promoting No Particular Order without express permission.
6. Coupons and Deals Policy
Only coupons and promotional codes provided directly by No Particular Order or through ShareASale are allowed.
Affiliates are prohibited from promoting unauthorized discount codes, expired promotions, or creating fake deals.
Affiliates may not list our deals on coupon or deal aggregation sites without prior approval from No Particular Order.
7. Special Commissions Rules
Commission rates and structures may vary based on specific promotions, product types, or affiliate performance.
No Particular Order reserves the right to adjust commission rates at any time with notice to the Affiliate.
Affiliates may earn additional bonuses or special commissions based on performance metrics, as defined in separate promotions communicated through ShareASale.
8. Pay-Per-Click (PPC) Bidding Rules
Affiliates may not bid on No Particular Order’s trademarked terms, brand names, or any variations thereof in any pay-per-click or search engine advertising.
The use of direct linking to No Particular Order's website from PPC ads is prohibited.
Affiliates found engaging in unauthorized PPC activities will be subject to termination and forfeiture of outstanding commissions.
9. Indemnification and Liability
The Affiliate agrees to indemnify and hold harmless No Particular Order from any claims, damages, or expenses arising from the Affiliate’s breach of this Agreement or violation of applicable laws.
No Particular Order shall not be liable for any indirect, special, or consequential damages arising from the Affiliate's participation in the program.
10. Agreement Modifications
No Particular Order reserves the right to modify the terms of this Agreement at any time. Changes will be communicated via ShareASale or email.
