Affiliate Agreement

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND Free Yourself. BY SUBMITTING THE ONLINE APPLICATION, YOU ARE AGREEING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THAT YOU AGREE TO BE LEGALLY RESPONSIBLE FOR EACH AND EVERY TERM AND CONDITION.
1. Overview
This Agreement contains the complete terms and conditions that apply to you becoming an affiliate in FreeYourself.com's Affiliate Program. The purpose of this Agreement is to allow HTML linking between your website and the FreeYourself.com website. Please note that throughout this Agreement, "we," "us," and "our" refer to FreeYourself.com, and "you," "your," and "yours" refer to the affiliate.
2. Affiliate Obligations
2.1. To begin the enrollment process, you will complete and submit the online application at the ShareASale.com server. We may reject your application at our sole discretion. We may cancel your application if we determine that your site is unsuitable for our Program, including if it:
- Promotes sexually explicit materials
- Promotes violence
- Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- Promotes illegal activities
- Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law
- Includes "Free Yourself" or variations or misspellings thereof in its domain name
- Is otherwise in any way unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically or otherwise objectionable to us in our sole discretion
- Contains software downloads that potentially enable diversions of commission from other affiliates in our program
2.2. As a member of FreeYourself.com's Affiliate Program, you will have access to Affiliate Account Manager. Here you will be able to review our Program’s details and previously-published affiliate newsletters, download HTML code, and access other resources. You must use the HTML code provided to ensure accurate tracking.
3. FreeYourself.com Rights and Obligations
3.1. We have the right to monitor your site at any time to ensure compliance with this Agreement. Non-compliance may result in termination of your participation in the program.
3.2. FreeYourself.com reserves the right to terminate this Agreement and your participation without notice if fraudulent activity is detected.
4. Termination
Either party may terminate this Agreement at any time, with or without cause, by providing written notice. Termination is immediate upon breach of this Agreement.
5. Modification
We may modify the terms of this Agreement at any time. You will be notified via email. Continued participation after changes implies acceptance of the modifications.
6. Payment
FreeYourself.com uses ShareASale.com for tracking and payment. Refer to ShareASale’s terms for details.
7. Access to Affiliate Account Interface
You will create a password to access reports and tracking via ShareASale’s secure interface.
8. Promotion Restrictions
8.1. You may promote your website but must not misrepresent your affiliation with FreeYourself.com. Spamming and trademark bidding are prohibited.
8.2. Affiliates engaging in prohibited activities will be banned and forfeit pending commissions.
9. Grant of Licenses
9.1. We grant you a non-exclusive, revocable right to access our site and use provided marketing materials under this Agreement.
10. Disclaimer
FreeYourself.com makes no warranties about its services or website. We are not liable for interruptions or errors.
11. Representations and Warranties
By entering into this Agreement, you warrant that you have the legal authority to do so and agree to its terms.
12. Limitations of Liability
FreeYourself.com is not liable for indirect damages or losses exceeding the total commission fees paid to you under this Agreement.
13. Indemnification
You agree to indemnify and hold FreeYourself.com harmless against claims arising from your website or breach of this Agreement.
14. Confidentiality
Confidential information shared during this Agreement must not be disclosed without written consent.
15. Miscellaneous
- 15.1. You are an independent contractor.
- 15.2. This Agreement is governed by the laws of Vermont.
- 15.3. This Agreement represents the entire agreement between you and FreeYourself.com.
By joining the program, you accept all terms outlined above.
