FEMMUE Affiliate Program Agreement
Effective Date: November 4, 2024
This FEMMUE Affiliate Program Agreement ("Agreement") is made by and between FEMMUE, a company of the Republic of Korea, and the affiliate ("Affiliate") participating in the FEMMUE Affiliate Program through ShareASale.
By signing up for the FEMMUE Affiliate Program, the Affiliate agrees to the following terms and conditions:
1. Program Overview
FEMMUE, a globally recognized Korean skincare brand, offers an affiliate program to reward affiliates for promoting our products via ShareASale.
Affiliates earn commissions on qualifying sales generated through their unique affiliate links.
2. Eligibility
Affiliates must be at least 18 years old.
Affiliates must operate a website, social media, or other digital platform with content that aligns with FEMMUE’s brand values and guidelines.
FEMMUE reserves the right to reject or terminate any affiliate application or partnership at its discretion.
3. Commissions and Payment
Commission Rate: Affiliates will earn a commission rate of 12% of each qualifying sale, exclusive of taxes, shipping, and discounts.
Average Order Value (AOV): Our AOV is approximately $60.
Payments are processed through ShareASale.
Payments are issued according to ShareASale’s payment schedule and terms.
4. Affiliate Responsibilities
Affiliates must maintain active promotion of FEMMUE products and adhere to our brand guidelines.
Affiliates must ensure their platforms and content adhere to ethical and legal standards, including, but not limited to, accurate disclosures of their affiliate relationship with FEMMUE, as required by the FTC.
Affiliates may not promote FEMMUE products on sites with offensive, inappropriate, or illegal content.
5. Promotional Materials
FEMMUE will provide affiliates with approved marketing materials, including banners, product images, and brand assets.
Affiliates must use only provided or approved materials in their promotions. Any modification to these materials without prior approval is prohibited.
6. Restrictions
Affiliates are prohibited from:
Purchasing keywords or domain names that include "FEMMUE" or any variations for paid search campaigns.
Misrepresenting or making false claims about FEMMUE’s products.
Using “spam” or unsolicited communications to promote FEMMUE products.
7. Termination
Either party may terminate this Agreement at any time with or without cause.
Upon termination, the Affiliate must remove all FEMMUE links and promotions from their platforms immediately.
Any outstanding commission payments due will be processed according to ShareASale’s final payment terms.
8. Liability
FEMMUE will not be liable for indirect, special, or consequential damages in connection with this Agreement or the Affiliate Program.
Affiliates agree to indemnify FEMMUE against any liability arising from their promotion of FEMMUE products.
9. Confidentiality
Affiliates agree to keep any FEMMUE-provided information, such as upcoming product releases or promotions, confidential unless otherwise specified.
10. Amendments
FEMMUE reserves the right to amend this Agreement. Affiliates will be notified of any changes, and continued participation in the program indicates acceptance of the amended terms.
11. Governing Law
This Agreement will be governed by the laws of the State of New York.
12. Acceptance By participating in the FEMMUE Affiliate Program, the Affiliate agrees to comply with all terms and conditions set forth in this Agreement.
