This is a legally binding agreement between you ("Affiliate") and the company operating the VANKYO brand ("we," "us," or "our").
By submitting your online application via Awin, you acknowledge that you have read, understood, and agree to be legally bound by the terms and conditions in this agreement.
1. OVERVIEW
This agreement outlines the complete terms and conditions for your participation in the VANKYO Affiliate Program (“the Program”), managed through Awin.
The Program allows you to promote ivankyo.com through tracked affiliate links and earn commissions on qualifying sales.
2. AFFILIATE OBLIGATIONS
2.1 Enrollment
You must complete an application through Awin. We may reject or remove your site if it:
Promotes explicit, violent, or discriminatory content
Encourages illegal activities or infringes IP rights
Uses “VANKYO” or misspellings in your domain
Mimics our brand or site design
Hosts unauthorized downloads that disrupt tracking
2.2 Link Use & Tracking
Use only Awin-generated tracking links. You are responsible for implementing tracking correctly.
2.3 Site Maintenance
You must maintain and update your promotional properties. We may request changes to ensure compliance.
2.4 Legal Compliance
Your content must comply with copyright and trademark laws. You must hold rights to all published materials.
3. OUR RIGHTS & OBLIGATIONS
3.1 Monitoring
We may audit your promotional methods at any time.
3.2 Fraud & Abuse
Any fraud or abuse will result in termination and loss of commissions.
3.3 Agreement Duration
This agreement remains active until terminated.
4. TERMINATION
Either party may terminate this agreement at any time with written notice (email acceptable). Breaches result in immediate termination.
5. MODIFICATIONS
We may update this agreement. Continued participation means acceptance. If you disagree, you may leave the Program.
6. PAYMENT
Commission tracking and payments are handled by Awin. Refer to Awin’s terms for payment timelines and rules.
7. AFFILIATE INTERFACE ACCESS
You’ll get access to Awin’s portal to track performance and download creatives.
8. PROMOTION RESTRICTIONS
8.1 General Restrictions
Do NOT engage in:
Spamming or unsolicited email (UCE)
Misrepresentation of affiliation
Concealing identity
Unauthorized brand or asset usage
8.2 Paid Search (PPC) Policy
Do NOT bid on:
"VANKYO" or related keywords
ivankyo.com or misspellings (e.g., VANKO, VANCO)
Direct linking to ivankyo.com is prohibited
All PPC traffic must go to your own website first.
8.3 Lead Forms
You may submit genuine leads only with user consent.
8.4 Prohibited Technology
You may not use software/tools that:
Overwrite cookies or redirect traffic
Inject, alter, or hijack site content
Affect affiliate tracking integrity
9. LICENSE GRANT
9.1 Use of Marketing Assets
You’re granted a limited, revocable license to use official creatives for Program purposes.
9.2 Restrictions
Do not use brand materials in misleading or offensive ways. All brand goodwill remains with the company.
10. DISCLAIMER
We make no warranties on the Program or product performance. We are not liable for errors or downtime.
11. REPRESENTATIONS & WARRANTIES
You confirm:
You have authority to join the Program
You own or control your promotional channels
You comply with laws and our terms
12. LIMITATION OF LIABILITY
We’re not liable for indirect or consequential damages. Maximum liability is the commissions paid to you.
13. INDEMNIFICATION
You agree to hold harmless the company operating the VANKYO brand from all legal claims arising from your participation.
14. CONFIDENTIALITY
Confidential information must not be shared without written consent.
15. MISCELLANEOUS
15.1 Independent Contractor
You act as an independent contractor, not as an employee or agent.
15.2 Assignment
You may not assign this agreement without approval. We may do so if acquired.
15.3 Governing Law
This agreement is governed by the laws of the State of California, USA.
15.4 Entire Agreement
This is the full agreement. It overrides all prior agreements.
15.5 FTC Compliance
You must clearly disclose your affiliate relationship in any public promotions.
