Program Terms

BODYHEALTH.COM, LLC AFFILIATE MEMBER TERMS & CONDITIONS

These Terms and Conditions pertain to the individual and/or Affiliate and/or company’s usage and participation in the BodyHealth.com, LLC Affiliate Program. By signing these Terms and Conditions, you agree to the following:

1. JOINING THE PROGRAM. By signing the Affiliate Member Terms and Conditions form and receiving approval by the Affiliate Manager, you will immediately become a BodyHealth.com, LLC Affiliate. Your participation in the program is solely for this purpose: to legally advertise the BodyHealth.com website and products and receive a commission on sales generated by the link provided to you by the Affiliate Manager.
 

2. AFFILIATE COMMISSIONS. You will receive a unique, trackable Affiliate link with which to send your customers to BodyHealth. This link has a cookie window of 30 days, meaning that if within 30 days of clicking your link they then purchase, you will receive a commission.

You will be paid commissions for all BodyHealth products that are purchased directly through this link on BodyHealth.com within 30 days of the customer clicking on the link. The commission for this is 20% of the amount paid by the customer, not including any shipping & handling fees they may have paid.

Commissions are usually paid out bi-weekly but are only guaranteed at least once a month. There are no minimum qualifying amounts that must be reached before a commission check is sent to you.

BodyHealth.com, LLC reserves the right to decline any commission that violates this document of Terms of Service.

A single customer can only be associated with one affiliate. In the case of a customer whom uses an affiliate link for one order and then a different affiliate link for another order on the same account, BodyHealth.com, LLC reserves the right to decline the commissions tied to the additional affiliates.

If any products are refunded, BodyHealth.com, LLC reserves the right to deduct the appropriate commissions from the Affiliate’s account.

Commissions are not paid on orders placed by the Affiliate him/or herself, nor on orders placed by any immediate family members of the Affiliate, i.e. spouse or children.

Commissions can only be paid for orders placed once an Affiliate has submitted the signed Terms and Conditions and submitted a completed W9 tax form to BodyHealth.com.
 

3. SHIPPING & CUSTOMER SERVICE. BodyHealth.com, LLC will do the shipping and handling of the Affiliate’s customer’s orders (shipping costs may be paid by the customer). BodyHealth.com will also provide any customer service that is needed once the sale has been completed including e-mailing shipment tracking information, answering customer service questions, handling cancellations, and any other related customer services duties. BodyHealth.com, LLC will take the responsibility to ensure your customer receives their products in a timely manner.
 

4. RETURNS. BodyHealth.com, LLC does accept returns, however we reserve the right to deduct any commissions already given on returned product from the Affiliate’s future commissions. Please see our return policy here for details: http://bodyhealth.com/pages/return-policy.
 

5. LINKING TO BODYHEALTH.COM. You may use graphic and text links both on your website and in emails that BodyHealth.com, LLC provides to you. The BodyHealth.com, LLC Affiliate Manager must give prior approval to any graphic or test links the Affiliate may create and wish to use to ensure both proper branding and that there are no unsupported claims made in BodyHealth.com, LLC’s name.

BodyHealth.com, LLC copy, logos, graphics, audio clips, videos, ads, print, web-based materials, email advertisements, etc. are copyrighted and may not be changed or added to without written consent. If an Affiliate would like to use one or more of them for promotional purposes just request them from the Affiliate Manager.
 

6. TRADEMARK/NAME. Affiliate understands and acknowledges that BodyHealth.com, LLC products are trademarked and registered marks and that they are the property of BodyHealth.com, LLC. Affiliates are strictly prohibited from bidding on the BodyHealth brand name, trademarked terms, or any misspellings or variations thereof (including but not limited to “BodyHealth,” “PerfectAmino,” “BodyHealth supplements,” “BodyHealth coupon,” “BodyHealth promo code,” etc.) in any pay-per-click (PPC), SEM, or paid search advertising platforms (e.g., Google Ads, Bing Ads). Additionally, affiliates may not use BodyHealth trademarked terms in the display URL, ad copy, meta titles/descriptions, or as part of TM+ bidding strategies (e.g., bidding on “BodyHealth coupon,” “BodyHealth reviews,” etc.). Violations of this policy may result in removal from the affiliate program and forfeiture of commissions.
 

7. PRODUCT CLAIMS. BodyHealth.com, LLC makes no health claims, express or implied, nor are the BodyHealth.com website, products, promotional materials or any other material created by or for BodyHealth.com, LLC intended for use in diagnosing, treating, curing, mitigating or preventing any disease, and Affiliate enters this Agreement with the understanding that BodyHealth.com, LLC dietary supplement products are not offered and will not be sold for such purposes.

Affiliate therefore agrees not to make any health claims for BodyHealth.com, LLC products.

Affiliate shall take no actions that are a violation of Federal or State law, including but not limited to requirements imposed by the U.S. Food and Drug Administration or the U.S. Federal Trade Commission.
 

8. DISCOUNT/CODE WEBSITES, COUPON CODES, AND PAID ADVERTISING. The Affiliate is not authorized to add or knowingly allow their affiliate code to be available on any discount/code website that offer these codes as standalone information (referred to hereafter as “discount/code website”). Any commission gained from a website whose sole purpose is to provide and spread discounts/codes will not be accepted. The commission will be declined and BodyHealth.com, LLC reserves the right to choose whether or not to terminate the affiliates contract. It is the responsibility of the affiliate to protect their commission code. If the affiliate is unable to remove their code from said discount/code website for any reason, it is the affiliates responsibility to contact BodyHealth.com, LLC via email at affiliatemanager@bodyhealth.com or a verifiable written form for further assistance and instructions pertaining to the removal of the affiliate code.

 

BodyHealth does not permit the use of coupon pop-ups on websites or at checkout, and no commissions will be paid for sales generated through such methods. Additionally, affiliates are prohibited from engaging in any form of paid advertising unless expressly authorized in writing by BodyHealth. Sales resulting from unauthorized paid advertising will not be eligible for commission. Furthermore, commissions will only be granted for coupon codes that are provided directly within the AWIN platform. Coupon codes originating outside of AWIN are not eligible for commission.

 

9. COUPON CODE POLICY: Only coupon codes that are explicitly provided to affiliates by the BodyHealth Affiliate Manager are eligible for commission. Use of any unapproved, unauthorized, or publicly available coupon codes may result in the transaction being non-commissionable. BodyHealth reserves the right to reverse commissions on any orders where an unapproved code is used, regardless of affiliate tracking. Affiliates may not promote or repurpose codes found on coupon or deal sites unless granted written permission. Violations of this policy may result in removal from the program and forfeiture of associated commissions. 

 

10. REVOCATION OF AFFILIATE STATUS. Your Affiliate application and status in the program may be suspended or terminated for any of the following reasons: Inappropriate advertisements (false claims, misleading hyperlinks), spamming (mass email, mass newsgroup posting, etc. in violation of CAM SPAM ACT of 2003 – Public Law No. 108-187, Federal Trade Commission regulations and guidelines implementing the FTC Act and all other federal and state consumer protection laws, regulations and guidelines), advertising on sites containing/promoting illegal activities, violation of intellectual property rights (copying BodyHealth.com material without express permission from the BodyHealth.com, LLC Affiliate Manager) or violation of any of theses terms and conditions.

Your participating website(s) may NOT contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information, or could otherwise be considered malware, or spyware. You may NOT engage in “domain recovery” or “domain redirection” strategies where misspelled versions of BodyHealth.com or derivatives are used to capture indirectly typed-in search queries that result in traffic routed through qualifying links or compose your website in an illegal manner designed to pull Internet traffic away from the BodyHealth.com website.

Affiliates may not advertise their Affiliate code or link in any online group owned or created by BodyHealth.com, LLC, or spend advertising dollars on the keywords BodyHealth, PerfectAmino, or any other product names owned by BodyHealth.com, LLC that would interfere with BodyHealth.com, LLC’s own marketing. This does not mean that an Affiliate cannot start their own group, have their own email list and promote BodyHealth.com, LLC products inside of that or that they may not use the above terms in their posts, articles, emails or other promotional materials. They just may not do so in an online group created by BodyHealth.com, LLC.
 

11. TERMS OF THE AGREEMENT. These terms will begin upon your signup with the Affiliate program and will end when either you or BodyHealth.com, LLC terminates your Affiliate status in writing. BodyHealth.com, LLC may modify the terms of this agreement at any time for prospective operation. If any modification is unacceptable to you, your only choice is to terminate your Affiliate status. Your continuing participation in the program will constitute your acceptance of any change. You also agree that upon termination of this BodyHealth.com, LLC Affiliate Agreement, for any reason, you shall immediately cease using all BodyHealth.com links, and displaying or otherwise maintaining any interest in BodyHealth.com or BodyHealth.com, LLC content.
 

12. INDEMNITY. Affiliate agrees to defend, save, indemnify, and hold harmless BodyHealth.com, LLC and its subsidiaries and Affiliates, and their directors, officers, employees, partners, and other owners from and against each and every claim, demand, liability, damage, loss, expense, lawsuit, or cause of action, and all loss or exposure by reason of liability imposed on BodyHealth.com, LLC for claims, damages, losses, and expenses, including but not limited to attorneys' fees and expenses incurred in defense of BodyHealth.com, LLC, arising out of, or in any way incidental to the purchase or end use of BodyHealth.com, LLC dietary supplement products purchased from Affiliate or its customers.
 

13. LIMITATION OF LIABILITY. BodyHealth.com, LLC is not liable to Affiliate for any consequences, whether foreseeable or unforeseeable, for incidental, consequential or compensatory damages due to interruptions or discontinuation of BodyHealth.com, LLC supply of BodyHealth.com, LLC dietary supplement products to Affiliate for any reason. BodyHealth.com, LLC offers no warranty to Affiliate or end users of the product that it will offer any benefit.
 

14. TERMINATION. BodyHealth.com, LLC reserves the right to terminate this Agreement without cause and without notice. If this program were discontinued, any earned commissions in Affiliate’s account would be paid in the Affiliate’s final payment.
 

15. INDEPENDENT CONTRACTOR. Affiliate agrees that he/she is an independent contractor, and nothing in this Agreement creates any partnership, joint venture, franchise, or employment relationship between Affiliate and BodyHealth.com. The Affiliate is responsible for reporting their earned income and paying their taxes according to the law. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida without regard to the conflicts of laws and principles thereof.
