Affiliate Program Agreement
1. Definitions
Affiliate: A person or entity that promotes the Merchant's Products or Services through their own marketing efforts.
Merchant: Botanical Beauty, Inc., the owner and operator of www.botanicalbeautyskin.com.
Products or Services: The goods or services offered by the Merchant.
Commission: The monetary compensation paid to the Affiliate for each qualified sale generated through their efforts.
2. Affiliate Program Terms
The Affiliate agrees to promote the Merchant's Products or Services in accordance with this Agreement and the Merchant's guidelines.
The Affiliate will receive a commission for each qualified sale or lead generated through their unique affiliate link.
The commission rate will be 10% of the total sale.
The Merchant reserves the right to modify the commission rate or program terms at any time, with reasonable notice to the Affiliate.
3. Affiliate Obligations
The Affiliate agrees to comply with all applicable laws and regulations, including but not limited to consumer protection laws, advertising standards, and data privacy laws.
The Affiliate will not engage in any fraudulent, deceptive, or misleading activities to promote the Merchant's Products or Services.
The Affiliate will not use the Merchant's trademarks, logos, or copyrighted materials without explicit permission.
4. Merchant Obligations
The Merchant will provide the Affiliate with the necessary tools and resources to promote the Products or Services.
The Merchant will track and report affiliate activity and commissions.
The Merchant will pay commissions to the Affiliate in accordance with the terms of this Agreement through ShareASale payout policy.
5. Termination
Either party may terminate this Agreement at any time, with or without cause, by providing written notice to the other party.
Upon termination, the Affiliate must immediately cease promoting the Merchant's Products or Services and return any confidential information or materials provided by the Merchant.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Utah.
7. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
