DaVinci Vaporizers

Please read these Affiliate Program Terms (“Terms”) carefully. These Terms govern your participation as an Affiliate (“you” or “Affiliate”) in the DaVinci Vaporizer Affiliate Program (“Program”) operated through the Awin affiliate network (“Awin”). By applying to or participating in the Program, you agree to be bound by these Terms.

As used herein, “DaVinci,” “we,” or “us” refers to Synergy Imports, LLC. “Site” refers to any website, social media account, channel, or digital property used by the Affiliate to promote DaVinci products.

To participate in the Program, you must submit a complete affiliate application through Awin. DaVinci reserves the right, in its sole discretion, to approve or reject any application.

Applications may be rejected or Affiliates removed if their content, audience, or promotional practices are deemed unsuitable, including but not limited to properties that:

• Promote violence, hate, or discrimination
• Promote illegal activity or unlawful product use
• Contain deceptive, misleading, or fraudulent claims
• Misrepresent themselves as DaVinci or impersonate brand channels
• Infringe upon DaVinci intellectual property
• Target minors or restricted audiences
• Violate applicable laws, regulations, or Awin policies

Acceptance into the Program does not guarantee ongoing participation.

Affiliates may use tracking links and approved creatives provided through the Awin platform. Only valid Awin-generated links are eligible for tracking and commission attribution.

DaVinci is not responsible for lost tracking due to improper link formatting, disabled cookies, browser limitations, ad blockers, or third-party interference.

Affiliates agree to the following:

• No framing, mirroring, or modification of DaVinci websites or content
• No impersonation of DaVinci or representation as an official brand channel
• No unsolicited email, spam, or unauthorized bulk messaging
• No redistribution of DaVinci customer or affiliate communications
• No misleading claims regarding product effects, legality, or use
   

DaVinci products are marketed for legal herbal use only. Content that promotes illegal substances, controlled substances, tobacco, nicotine, or unlawful behavior is strictly prohibited.

Affiliates may not:

• Register domains containing “DaVinci,” product names, or variations
• Bid on DaVinci trademarks, brand terms, or misspellings in paid search
• Use DaVinci trademarks in paid ads without prior written consent
   

Approved use of trademarks is limited to creatives supplied or approved through Awin and must not imply endorsement beyond the affiliate relationship.

All customer transactions, fulfillment, returns, and customer service are handled exclusively by DaVinci. Customers purchasing through affiliate links are customers of DaVinci.

DaVinci reserves the right to cancel, reject, or refund orders in accordance with its policies.

Affiliate commissions are calculated on qualifying net sales, excluding taxes, shipping, refunds, chargebacks, fraudulent transactions, and non-qualifying orders.

Commission validation follows DaVinci’s published returns period plus Awin’s validation buffer. Transactions not declined within the validation window may auto-approve per Awin policy.

Commission rates and structures are defined within the Awin platform and may be updated at any time.

DaVinci reserves the right to monitor Affiliate activity to ensure compliance with these Terms. Affiliates agree to cooperate reasonably in the event of a compliance review.

Violations may result in withheld commissions, suspension, or removal from the Program.

Either party may terminate participation in the Program at any time. DaVinci may terminate immediately for violations, fraud, misrepresentation, or non-compliance.

Upon termination, Affiliates must promptly remove all DaVinci links, trademarks, and promotional materials.

Affiliates are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship.

Affiliates have no authority to bind or represent DaVinci.

Non-public information relating to DaVinci’s operations, pricing, commissions, or business practices is confidential and may not be disclosed without prior written consent.

DaVinci shall not be liable for indirect, incidental, or consequential damages arising from participation in the Program. DaVinci’s total liability shall not exceed commissions paid or payable to the Affiliate.

Affiliates agree to indemnify and hold harmless DaVinci, its officers, employees, and partners from any claims, losses, or damages arising from Affiliate content, conduct, or breach of these Terms.

DaVinci may modify these Terms at any time by posting updated terms within Awin or providing notice through the platform. Continued participation constitutes acceptance of any modifications.
