GammonVillage Store Affiliate Program Terms & Conditions
To become a GammonVillage Store Affiliate, you must agree to the terms and conditions set forth below.
1. Enrollment in the Program
- To join the GammonVillage Store Affiliate Program:
- Complete and submit the online application.
- By applying, you agree to all the terms in this Agreement.
- We will review your application and notify you by email of acceptance or rejection.
- We reserve the right to reject any site we consider inappropriate, including (but not limited to) sites that:
- Promote violence or sexually explicit content
- Encourage illegal activities
- Discriminate based on race, sex, age, nationality, disability, sexual orientation, or religion
- Violate intellectual property rights
2. Linking to the GammonVillage Store
- You’ll add approved links and videos to your website. Banners, text ads, and ready-to-publish articles will be provided upon request.
- These materials are provided upon acceptance and can be found in your affiliate console.
3. Order Processing
- GammonVillage processes all customer orders placed through your links.
- We handle payment, order cancellations, returns, and customer service.
- You must correctly implement all links and banners to ensure proper tracking.
- We are not responsible for tracking errors due to incorrect link placement.
4. Commission Fees
- You earn a commission only if:
- The customer clicks your affiliate link to visit the GammonVillage Store.
- The customer makes a purchase within 60 days of clicking your link.
- The customer does not click another affiliate’s link or disable cookies.
- The order is paid for in full and successfully delivered.
- The purchased items are not on sale and do not include free delivery.
Important Notes:
- Commissions are confirmed after a 60-day window (to allow for returns or cancellations).
- No commissions are paid on refunded or charged-back orders.
- You may purchase for personal use, but not for resale or commercial use.
5. Commission Rate
- You earn 10% commission on all regular-priced products.
(Excludes shipping, handling, and taxes.) - Commissions are calculated monthly.
6. Payment of Commissions
- Payments are managed via Awin (www.awin.com).
- You will be paid monthly if your balance is $25 or more.
- If under $25, your commissions are held until the threshold is reached.
- Payments follow the ShareASale schedule.
- A 60-day approval period applies to all commissions.
- Upon termination, final payments will still be sent for earned commissions.
- If a product generating commission is returned, the corresponding fee will be deducted from your next payment.
7. Program Policies & Pricing
- All customers referred through the program are GammonVillage customers.
- GammonVillage may modify pricing, promotions, or procedures at any time.
- 8. Link Format Requirements
- You must use only approved ad banners or text links provided by GammonVillage.
- Modifying banners or ads without written consent is prohibited.
- 9. Use of GammonVillage Assets
- All trademarks, images, and content on GammonVillage.com are owned by GammonVillage Inc.
- You are granted a limited, non-exclusive, revocable license to use approved materials solely to promote the store.
- This license may be revoked at any time with written notice.
10. Responsibility for Your Site
- You are fully responsible for:
- The operation and maintenance of your site
- Ensuring content does not violate copyrights, trademarks, or any third-party rights
- Ensuring your site’s content is lawful and not libelous
- You agree to indemnify and hold GammonVillage harmless from any claims related to your site.
You must not:
- Create customer confusion about your relationship with GammonVillage
- Use pop-ups, framing, or spam to promote links
- Compete with GammonVillage using paid ads (Google Ads, Bing, etc.)
- Offer unauthorized discounts or coupons
- Violations may result in withholding commissions or termination.
11. Term & Termination
- The Agreement begins upon acceptance into the program.
- Either party may terminate at any time, with or without cause, by email or written notice.
- Upon termination, you must:
- Remove all links, banners, and trademarks from your site
- Cease using all GammonVillage assets immediately
- The Agreement also terminates automatically upon bankruptcy, dissolution, or assignment to creditors.
12. Modification of Terms
- GammonVillage may update this Agreement at any time by posting a new version online.
- Continued participation after updates means you accept the new terms.
- If you do not agree, your only option is to terminate participation.
13. Relationship of the Parties
- You are an independent contractor, not a partner, agent, or employee.
- You may not represent yourself as acting on behalf of GammonVillage in any form.
14. Limitation of Liability
- GammonVillage is not liable for:
- Indirect, special, or consequential damages
- Loss of revenue, profits, or data
Total liability will not exceed the total commissions paid to you.
15. Disclaimers
- GammonVillage makes no warranties, express or implied, regarding:
- The affiliate program
- The products sold through it
- The uninterrupted or error-free operation of its website
16. Independent Investigation
- By applying, you acknowledge that:
- You have read and agree to all terms.
- You understand GammonVillage may operate or promote similar programs.
- You have independently evaluated the desirability of participation.
17. Miscellaneous
- Governed by the laws of Ontario, Canada.
- Any disputes must be brought in Toronto, Ontario courts.
- You may not assign this Agreement without written consent.
- This Agreement binds both parties and their successors.
- Failure to enforce any provision does not waive future enforcement rights.
