This Affiliate Program Agreement (the “Agreement”) sets forth the terms and conditions for participation in the Avisar Resorts Affiliate Program (the “Program”). By signing up as an affiliate and participating in the Program, you agree to comply with the terms outlined below, as well as the awin Terms of Use.
1. Program Eligibility
1.1. Affiliates must be 18 years or older to participate.
1.2. Affiliates must have a valid and active website, blog, or social media presence.
1.3. Avisar Resorts reserves the right to accept or reject any application at its sole discretion.
2. Commission Structure
2.1. Affiliates will earn a 10% or more commission on the total value of bookings generated through their affiliate link.
2.2. Commissions are paid on completed bookings only. Canceled bookings or those refunded to the customer are not eligible for commissions.
2.3. Payments will be processed monthly, with a minimum payout threshold of $50.
3. Affiliate Responsibilities
3.1. Affiliates must promote Avisar Resorts in a lawful, ethical, and respectful manner.
3.2. Affiliates must disclose their affiliate relationship with Avisar Resorts in accordance with FTC guidelines.
3.3. Affiliates must not engage in activities that could harm Avisar Resorts’ reputation, including but not limited to:
• Promoting false or misleading claims about Avisar Resorts.
• Spamming or using unauthorized email marketing campaigns.
• Offering unauthorized discounts or incentives.
3.4. Affiliates must not bid on Avisar Resorts’ brand name or related keywords in pay-per-click campaigns.
4. Prohibited Activities
4.1. Affiliates may not use cookie stuffing, link cloaking, or other fraudulent techniques to generate commissions.
4.2. Affiliates may not use Avisar Resorts’ intellectual property, including trademarks, logos, or images, without prior written approval.
4.3. Affiliates may not engage in:
• Promoting on adult, violent, or discriminatory content platforms.
• Promoting on platforms associated with illegal activities.
• Promoting on coupon or deal sites without authorization.
4.4. Affiliates may not impersonate Avisar Resorts or create misleading representations of being an official agent or employee.
5. Termination of Agreement
5.1. Avisar Resorts reserves the right to terminate an affiliate’s participation in the Program at any time, with or without cause.
5.2. Affiliates found violating any terms of this Agreement will be immediately removed from the Program, and all pending commissions will be forfeited.
6. Relationship of Parties
6.1. Affiliates are independent contractors and not employees, agents, or representatives of Avisar Resorts.
6.2. Participation in the Program does not create any joint venture, partnership, or franchise relationship between the parties.
7. Confidentiality
7.1. Affiliates may have access to confidential information, including but not limited to booking data and commission rates. Such information must not be disclosed or used for any purpose outside the Program.
8. Amendments and Modifications
8.1. Avisar Resorts reserves the right to amend or modify this Agreement at any time. Affiliates will be notified of any changes via email or through their affiliate account. Continued participation in the Program after changes are made constitutes acceptance of the new terms.
9. Limitation of Liability
9.1. Avisar Resorts will not be liable for indirect, special, or consequential damages arising in connection with this Agreement or the Program.
9.2. Avisar Resorts does not guarantee that the operation of its website or affiliate tracking will be uninterrupted or error-free.
10. Governing Law
10.1. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
11. Acceptance
By participating in the Program, you agree to abide by the terms of this Agreement. If you do not agree with any part of this Agreement, you must not participate in the Program.
